Dehradun: The Uttarakhand high court (HC), while deliberating on petitions filed by jail inmates regarding conferment of parole and furlough, directed the police chiefs of the districts across the state to forward such applications to the inspector general (prisons), rather than the HC.
The court further explained that the Uttarakhand Jail Manual (Rules) 2023 mandates that the IG prison is the competent authority to authorise regular parole and furlough.
Furthermore, the HC emphasised that undertrial prisoners are ineligible for parole and furlough.
The applications for parole were submitted by petitioners through the Haridwar jail superintendent. The state counsel asserted by invoking Rule 511 of the Jail Manual that the IG (prisons) has been empowered to sanction regular parole or furlough, “therefore, these applications should not be sent to the HC”.
The division bench of Manoj Tiwari and Pankaj Purohit said, “We expect that the needful shall be done by the senior superintendent of district jail in Haridwar within a week. The IG (prisons) shall consider the request made by petitioners and make a decision within 15 days thereafter.” Pankul Sharma
