Meghalaya denies quota for ‘non-creamy’ ST class
Shillong: Meghalaya legislative assembly, in a voice vote on Tuesday, rejected the proposed Meghalaya Reservation for Non-Creamy Layer of Scheduled Tribes (in State Reservation Policy) Bill, 2024. The bill, introduced by opposition Voice of the People Party (VPP) legislator Adelbert Nongrum from North Shillong, aimed to provide reservations for the non-creamy layer of Scheduled Tribes.

Notably, none of the opposition members supported the proposed legislation.
The bill’s statement of object and reasons highlighted that data available to the Meghalaya govt indicates economic vulnerability among a significant percentage of the state’s ST population.
The Constitution of India, under Articles 16(4) and 15(5), empowers states to create provisions ensuring that reservation benefits reach the most disadvantaged citizens. A recent Supreme Court decision authorised sub-classifications within the Scheduled Caste (SC) and ST categories.
To address economic disparities within the Scheduled Tribe category in Meghalaya and promote equitable allocation of opportunities in public employment and higher education, appropriate legislation is essential. The proposed Bill aimed to benefit the state’s disadvantaged population.
