Supreme Court candidates must get benefit of quota as per Constitution: CM Yogi Adityanath

Chief minister Yogi Adityanath emphasized that all scheduled caste candidates must benefit from reservations as per the Constitution. Following the Allahabad High Court's ruling to redraw the merit list for 69,000 assistant teachers, he instructed the education department to act accordingly. The court directed a fresh merit list to be prepared within three months adhering to specific rules.

LUCKNOW: Chief Minister Yogi Adityanth said on Sunday that all scheduled caste candidates must be given the benefit of reservation as per the Constitution.
While reviewing the situation after the Allahabad high court's order to redraw the merit list for the selection of 69,000 assistant teachers, the CM also said that no injustice should be done to any candidate.

The CM chaired a meeting of senior officials of the education department to discuss the issue on Sunday. "He was apprised about all aspects of the high court order. He ordered that the department should act as per the order of the court," he added.
A division bench of Justice AR Masoodi and Justice BR Singh, in its Aug 13, 2024 judgment directed the state govt or competent authority to prepare a fresh merit list for the selection of 69,000 assistant teachers within three months, by following section 3(6) of the Reservation Rules 1994 and Basic Education Rules 1981. It, however, asked the government to follow the Asst Teachers Recruitment Exams-19 results.
A single bench in March 2023 had advised the govt to revise the merit list prepared in June 2020 to select 69,000 teachers as certain reservation rules had not been followed.
However, the division bench asked the govt to totally ignore the list and prepare a fresh list.
It ruled that the candidates of the reserved category would be migrated to the general category on securing marks in the merit prescribed for the general category.

"If a reserved category candidate acquires merit equivalent to the merit prescribed for the general category, the Meritorious Reserved Category candidate shall be migrated to the general category as per the provisions contained in Section 3 (6) of the Reservation Act, 1994," the court ordered.
The bench refused to interfere in the decision of the single bench which had rejected the select list of 6800 candidates of additional reserved category on January 5, 2022, in the course of the same recruitment examination.
