Thane: The Motor Accident Claims Tribunal (MACT) in Thane has awarded Rs 16.9 lakh as compensation to the family of a 21-year-old man from Palghar who lost his life in a
road accident in 2020.
The victim's mother, as well as his brother, who are residents of Vikramgad, recently filed a petition under Section 166 of the Motor Vehicles Act seeking compensation.
In their petition, through their legal team, the claimants said that the deceased was riding his scooter on March 21, 2020, when he was hit from behind by a car.
The deceased sustained fatal injuries and succumbed to them in the hospital.
Subsequently, the case was registered with the local police station and the accused car owner was booked.
The claimants sought the compensation on the grounds that the deceased was doing cutlery business and earning Rs 15,000 per month.
The opponents, denied all the allegations in the tribunal
After careful consideration of the evidence, including police reports and witness statements, MACT Chairman S. B. Agrawal ruled that the accident was caused by the negligence of the car driver.
The tribunal assessed the deceased's notional income at Rs 10,000 per month, factoring in future prospects and other considerations as per recent Supreme Court guidelines.
The final compensation amount of Rs 16.9 lakh includes Rs 16.2 lakh for loss of income, Rs 15,000 for loss of estate, Rs 40,000 for loss of filial consortium, and Rs 15,000 for funeral expenses, the tribunal ordered.
The tribunal further ordered that Rs 15 lakh of the total amount be kept in a fixed deposit for five years in the name of the deceased's mother.
The remaining amount, along with accrued interest, will be paid to the petitioners via account payee cheques.
This judgment, delivered on August 5, 2024, brings closure to a case that had been ongoing since October 2020.
